You seem to make it sound like only King George the Bush does this kind of thing, when reality proves that law is a game that keeps the wool pulled over the eyes of those allowed to have portions of “privilege” (for now), while the non-privileged (any and all perceived enemies or scapegoats of ‘society’) get to experience reality without all the comfiness.

For instance, let’s not forget the American indigenous folks and the lie of treaty laws.

Or how about Supreme Court decisions which are very very unpopular, like the one that allows artists to SELL their art WITHOUT A PERMIT everywhere in the land because it boils down to a 1st Ammendment ideal. See background info here:

With experiences and truths like these, you can’t help but wonder…even when Bush II steps down, the emperor to replace him will be no better than before. If “Democrat” or even some improbable “Third Party” President, we’ll only get a little more decor to give us the APPEARANCE of something different!

Yes, good point. While this article focused on Bush, the laying of the foundation for expanded presidential powers certainly extends into the future of the U.S. governmental structure.

The other things you mention are way, way beyond the scope of this article. Certainly worthy of discussion.

Great article!
This is one of the most important things happening in our federal government. Especially as Alito is confirmed, the citizens of the United States should know what ideology that they are giving a seat on the supreme court for life.
Congress needs to step up and explain to this king that his word is not law. They must explain that legislation is THEIR jurisdiction and all he does is sign it then enforce it. The courts must also adjudicate on this obvious line-item veto(that can end up justifying FAR more)
I have been looking for a link to the AUMF also.

More and more evidence traces this ideology to Carl Schimitt and before him to Thomas Hobbes. If anyone has read leviathan, the main assumption is that people are all basically evil and therefore must be controlled. It is different from Platonic idea that the people are too stupid so must be controlled. The neo-cons are also called Straussians and Strauss is generally considered a platonist or ascriber to Machiavelli’s ideals. Hobbes and Schmitt seem to be a very similar ideology, but in a different vein altogether.

I will miss our constitution. It was the best thing the United States had to offer.

Hopefully Gore’s speech will generate a great deal of press about the abuses of power.

I find your investigation of the reliance of the Bush Administration on the AUMF for establishing authority beyond the interpretation of his consitutionaly authority to be extremely interesting. Amazing what sorts of long term precedents can be set (Patriot Act, AUMF powers) with just the right kind of political climate….

I agree that this is one of the most important things happening right now, on the federal level. Alito ‘s probable confirmation makes spreading this news all the more pressing. Whatever a person’s stance on the various issues that might come before the Supreme Court, the issue of the scope of presidential power is one that will echo for years. This strategy has been built so carefully over so many years, with Alito as one of its architects.

If Congress doesn’t take a stance on the unconstitutional use of the line-item veto, we risk losing all the checks and balances that were so carefully crafted by the founders of the United States.

This should not be framed as a Democrat issue — this crosses party lines.
